Keyes Technology, LLC. d/b/a Flight Schedule Pro and its affiliates (collectively, “Flight Schedule Pro,” “we,” “us,” or “our”) value the privacy of individuals who use our applications, website (including https://www.flightschedulepro.com/), or services that link to this Privacy Policy (collectively, our “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and disclose Personal Information received from users of our Services. As used in this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as otherwise defined by applicable law. By using our Services, you agree to the collection, use, and disclosure of your Personal Information as described in this Privacy Policy. Beyond this Privacy Policy, your use of our Services is also subject to our End-User License Agreement.

Information We Collect and Receive

We may collect and receive a variety of information from you or about you or your devices from various sources, as described below. If you do not provide your information when requested, you may not be able to use our Services if that information is necessary to provide you with our Services or if we are legally required to collect it.

A. Information You Provide to Us

Registration and Profile Information. When you sign up for a user account or register to use our Services, we ask you for your Personal Information, including your name, email, date of birth, address, type of pilot, and total flight hours (“Registration Information”).

Pilot and Student Pilot Information. We may ask you for your date of birth, social security number, passport number, flight training records, nationality, gender, driver’s license number, driver’s license state, photo identification, and emergency contact information on behalf of organizations that use our Services. Additionally, to help remind you of expiration and pilot currency dates, you can provide us with pilot currency information, such as flight review date, medical expiration date, medical certificate number, medical certificate type, ratings, and certificate information, as well as information on your insurance provider and coverage expiration.

Contests and Sweepstakes Information. If you participate in a contest or sweepstake with us, we may receive additional Personal Information, including your full name, phone number, e-mail address, and street address.

Communications with Us. If you contact us directly, we may receive additional Personal Information about you. For example, when you contact us for support, we may receive your name, email address, phone number, and any additional information you choose to provide. If you subscribe to our newsletter, we will receive your email address. If you fill out our optional questionnaire, we may receive Personal Information and information regarding your interests and needs.

Content That You Provide Through Our Services. We collect and store content that you post, send, receive, and share via our Services. This content includes any information about you that you may choose to include. Content also includes any files and links you choose to upload to our Services. For example, the types of content we collect and store might include: user interest information and needs when you fill out a questionnaire. You also provide content to us when you choose to submit information to our websites, including social media websites operated by us.

Payment Information. When you make a payment to Flight Schedule Pro, your credit card information, debit card information, billing information, and any other financial information necessary to complete your payment (“Payment Information”) is processed by our third-party payment processors (for example, Stripe or ProPay), and we do not collect, store, or process your Payment Information. For more information, please see the ‘Section C Payment Processing’ below.

Audio and Video Information. With your consent, our Services may request access to the camera and microphone on your device. This information is used to provide our Services to you (e.g., to support audio and video engagements between students and instructors).

Careers. If you decide to apply for a job with us, you may submit your contact information and your resume online. We will collect the information you choose to provide us as part of your job application, such as your contact information, current employment information, and other information you choose to submit with your application and on your resume. If you apply for a job with us through a third-party platform, we will collect the information you make available to us through such third-party platforms.

B. Information We Collect Automatically When You Use our Services

Usage Information. To help us understand how you use our Services and to help us improve it, we automatically receive information about your interactions with our Services, such as the pages or other content you view, the searches you conduct, and the dates and times of your visits.

Device Information. We collect information about the device and software you use to access our Services, including IP address, web browser type, operating system version, and device identifiers - including unique device identifiers and MAC addresses.

Location Information. When you use our Services, we may infer your general location information. For example, your IP address may indicate your general geographic region. We use this data to provide features of our Services and to improve and customize our Services. You can enable or disable location services when you use our Services at any time by way of your device settings.

Analytics Partners. We use analytics services such as Google Analytics or Pendo to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/ and opt out of them by downloading the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout.

Information from Cookies and Similar Technologies. We may collect Personal Information using cookies, which are small files of letters and numbers that we store on your browser or the hard drive of your computer. We may also use pixel tags and web beacons on our Services. These are tiny graphic images placed on web pages or in our emails that allow us to determine whether you have performed a specific action. We use cookies, beacons, invisible tags, and similar technologies (collectively “Cookies”) to collect information about your browsing activities and to distinguish you from other users of our Services. This aids your experience when you use our Services and allows us to improve the functionality of our Services. Cookies can be used for performance management (collecting information on how our Services are being used for analytics purposes). They can also be used for functionality management, enabling us to make your visit more efficient by, for example, remembering language preferences, passwords, and log-in details. Third Party Use of Cookies and Other Tracking Technologies. Some content or applications, including advertisements, on our website are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use Cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. C. Payment Processing

When you make purchases through our Services, your payment is processed by third-party payment processors (“Payment Processors”). These Payment Processors may collect payment information and other Personal Information from you, including your name, email address, and billing address. The use of your Personal Information by the Payment Processors is governed by their terms and conditions and privacy policy, and Personal Information we receive about you from our Payment Processors is governed by this Privacy Policy.

D. Information We Receive From Third Parties

Information From Third-Party Services. If you choose to link our Services to a third-party account, we may receive Personal Information about you including your profile information and your use of the third-party account. If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options.

Flying Organizations. If you register with a flight school, university, training center, or flying club (“Flying Organization”), we may receive your Personal Information from the Flying Organization, including reservation information, documents, emergency contact information, profile photo, photo identification, pilot certificate, medical certificate or BasicMed certification number, TSA verification, TSA Security Training, flight training records, endorsements and/or checkouts.

Other Third Parties. We may receive additional information about you, such as pilot information and experience, from third parties, such as Flying Organizations, airlines, or aviation partners, and combine it with other information we have about you.

Affiliates. If you create an account with certain of our affiliates, such as Coradine Aviation Systems, LLC (“Coradine”), we will receive any Personal Information you provide to such affiliates, which may be shared with third parties, as applicable and as described below, when you register or create an account to use their services.

Additionally, if you create an account with our student loan provider affiliates, we may also receive your Personal Information and associated loan details, including but not limited to, loan status, balances, and disbursement amounts.

How We Use the Information We Collect

We use the Personal Information we collect:

  • To provide, update, maintain, and enhance our services;
  • To test and develop new products, services, and features;
  • To allow you to participate in interactive features of our Services when you choose to do so;
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you;
  • To facilitate transactions and payments;
  • To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide customer support;
  • To find and prevent fraud, and respond to trust and safety issues that may arise;
  • To conduct benchmarking, analytics, and industry analysis;
  • To de-identify and aggregate information collected through our Services and use it for any lawful purpose;
  • For compliance purposes, including enforcing our End User License Agreement or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency;
  • To process your job application; and
  • For other purposes for which we provide specific notice at the time the Personal Information is collected.

Legal Bases for Processing European Information

If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), we only process your Personal Information when we have a valid “legal basis,” including as set forth below.

  • Consent. We may process your Personal Information where you have consented to certain processing of your Personal Information. For example, we may process your Personal Information to send you marketing communications or to use Cookies where you have consented to such use.
  • Contractual Necessity. We may process your Personal Information where required to provide you with our Services. For example, we may need to process your Personal Information to respond to your inquiries or requests.
  • Compliance with a Legal Obligation. We may process your Personal Information where we have a legal obligation to do so. For example, we may process your Personal Information to comply with tax, labor and accounting obligations.
  • Legitimate Interests. We may process your Personal Information where we or a third party have a legitimate interest in processing your Personal Information. Specifically, we have a legitimate interest in using your Personal Information for product development and internal analytics purposes, and otherwise to improve the safety, security, and performance of our Services. We only rely on our or a third party’s legitimate interests to process your Personal Information when these interests are not overridden by your rights and interests.

How We Share the Information We Collect

We do not share or otherwise disclose the Personal Information we collect from you except as described below or otherwise disclosed to you at the time of the collection.

Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Services.

Partners and Affiliates. We may share any information we receive with our partners, corporate affiliates, parents, or subsidiaries for any purpose described in this Privacy Policy. When you register for an account to use our Services, we will share your Registration Information with our affiliate, Coradine, to create an account for you to use Coradine’s services.  

As applicable, we may also share de-identified flight training records and other flight school training performance indicators with our partners and corporate affiliates, such as lenders that have established an integrated student loan relationship with the owner of your flight school training program.  Additionally, when you create an account with such partners and corporate affiliates, your personal flight training records may be shared with said partners and corporate affiliates in order for the lenders to evaluate the appropriate amount of a loan disbursement under the terms of a loan agreement you made with the lender.

Customers. We may share any information we receive with customers, such as Flying Organizations, airlines, or the Federal Aviation Administration, for the purpose described in this Privacy Policy.

Marketing. We do not rent, sell, or share information about you with non-affiliated companies for their direct marketing purposes unless we have your permission.

Advertising Partners. We work with third-party advertising partners to show you ads that we think may interest you. These advertising partners may set and access their own Cookies, pixel tags and similar technologies on our Services and they may otherwise collect or have access to information about you which they may collect over time and across different online services. Some of our advertising partners are members of the Network Advertising Initiative or Digital Advertising Alliance. If you do not wish to receive personalized ads, please visit their pages (linked above) to learn about how you may opt out of receiving web-based personalized ads from member companies.

As Required by Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information if we believe doing so is required or appropriate to: (i) comply with law enforcement requests and legal process, such as a court order or subpoena; (ii) respond to your requests; or (iii) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your Personal Information may occur if you post any objectionable content on or through our Services.

Merger, Sale, or Other Asset Transfers. We may disclose and transfer your Personal Information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our business or assets.

Consent. We may also disclose Personal Information from or about you or your devices with your permission.

Your Choices About How We Use and Disclose Your Information

Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us.

Do Not Track. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our website may then be inaccessible or not function properly.

State Privacy Rights.

Subject to applicable law, you may have various privacy rights concerning the information we process about you, including but not limited to:

  • Right to withdraw consent: You have the right to withdraw their consent to the processing of your Personal Information at any time.
  • Right to object: You can object to the processing of your Personal Information based on legitimate interests or for direct marketing purposes.
  • Right of access: You can request access to your Personal Information and obtain information about the processing activities.
  • Right to rectification: You can request the correction or update of inaccurate or incomplete Personal Information.
  • Right to restrict processing: You have the right to restrict the processing of your Personal Information under certain circumstances.

  • Right to verify: Requests for access to or erasure of Personal Information are subject to our ability to reasonably verify your identify in light of the information requested and pursuant to requirements, limitations, and regulations of relevant and applicable state law. To verify your access or erasure request, please follow the instructions provided in our response to your request.
  • Right to data portability: You can request to receive your Personal Information in a structured, commonly used, and machine-readable format. We commit not to charge any fees for processing or responding to your requests. However, exceptions may apply if we deem a request to be excessive, repetitive, or manifestly unfounded. In such instances, we will explain our rationale and provide a cost estimate before proceeding with the request.
  • Right to lodge a complaint: You have the right to lodge a complaint with an applicable data protection authority regarding the processing of your Personal Information.
  • Right to Equal Service and Price. You may have the right not to receive discriminatory treatment for the exercise of your statutory privacy rights, subject to certain limitations.
  • Right to Opt-out: You may opt out of certain Personal Information processing for targeted advertising, sales, or profiling.

If you make a rights request, we may be required to respond to you within one month. If you choose not to provide us with the Personal Information we collect, some features of our Services may not work as intended.

Bear in mind that to evaluate your privacy rights requests, we need to be sure it was you who made the request. Consequently, we might need some identification to check that you are who you say you are. If you are acting as an authorized agent to make a request to know, delete, or opt out on behalf of a resident who may enforce these rights under applicable law, please contact our team by email at privacy@flightschedulepro.com to submit a verifiable request attaching a written authorization signed by the customer.

Upon receiving your request, we will acknowledge its receipt within ten (10) days. In our confirmation, we will outline our identity verification process (if necessary) and provide an estimated timeframe for response, unless the request has already been granted or denied. Please allow up to thirty (30) days for our response to your requests (excluding requests to stop selling your Personal Information) from the date of receipt. If additional time is required [up to a total of ninety (90) days], we will notify you in writing, explaining the reason for the extension. For account holders, our written response will be sent to the contact details associated with that account. For non-account holders, our response will be sent electronically, unless otherwise requested. In cases where a request cannot be fulfilled, we will provide the reasons for our decision in our response.

Your European Privacy Rights. If you are located in the EEA or the UK, you have additional rights described below.

  • You may request access to the Personal Information we maintain about you, update and correct inaccuracies in your Personal Information, restrict or object to the processing of your Personal Information, have your Personal Information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your Personal Information to another company. In addition, you also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
  • You may withdraw any consent you previously provided to us regarding the processing of your Personal Information at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.

Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain Personal Information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

International Personal Data Transfers

If you choose to use our Services from the EEA, the UK, or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your Personal Information outside of those regions to the U.S. for storage and processing. We may transfer Personal Information from the EEA or the UK to the U.S. and other third countries based on European Commission-approved or UK Government-approved Standard Contractual Clauses, or otherwise in accordance with applicable data protection laws. Flight Schedule Pro’s Cookie Privacy Preference Center can be used to view Cookie details, configure Cookie consent, and/or configure Cookie blocking. The Privacy Preference Center is accessed by clicking the Cookie icon on our website or web application. If you choose to block Cookies, you may not be able to access all or parts of our Services. By using our Services, you consent to our use of essential Cookies and our processing of Personal Information collected through such Cookies, in accordance with this Privacy Policy. You can withdraw your consent at any time by leveraging Flight Schedule Pro’s (Cookie) Privacy Preference Center.

You should understand that some features of our Services may not function properly if you do not accept Cookies or these technologies. Where required by applicable law, you will be asked to consent to certain Cookies and similar technologies before we use or install them on your computer or other device.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate (“Third-Party Services”). We are not responsible for the privacy practices, policies, or other content of these Third-Party Services. Please be aware that this Privacy Policy does not apply to your activities on these Third-Party Services or any information you disclose to these Third-Party Services. If you have any questions about how these other sites use your Personal Information, you should contact them directly. We encourage you to read their privacy policies before providing any information to them.

Data Subject Rights

If our processing of your Personal Information is subject to applicable data protection or privacy laws like the CCPA, GDPR, or other state comprehensive privacy law, you have specific rights concerning your Personal Information that we collect and process. When Flight Schedule Pro functions as the data controller, you can directly contact us at privacy@flightschedulepro.com to exercise your privacy rights. However, if our role is solely that of a service provider and we process your Personal Information solely based on the instructions of our customer (e.g., a flight training program), then you must contact that customer to exercise your privacy rights. The customer will then inform Flight Schedule Pro of any changes or corrections required for your Personal Information based on your request.  We only serve as the data controller when we determine which of your Personal Information to process and for what purpose. 

Data Security

Flight Schedule Pro recognizes the importance of data security and shall implement and maintain appropriate technical and organizational security measures to ensure a level of security appropriate to the risk. These security measures may be subject to technical progress and development, and Flight Schedule Pro may update or modify the security measures from time to time.

If you believe that our processing of your Personal Information infringes the GDPR, you have a right to lodge a complaint with a supervisory authority. Additionally, we would appreciate the opportunity to address your concerns directly.

Retention

When you request that we do so, we take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When we process Personal Information for our own purposes, we determine the retention period taking into account various criteria, such as the type of services provided to you, the nature and length of our relationship with you, possible re-enrollment with our Services, the impact on our Services we provide to you if we delete some information from or about you, and mandatory retention periods provided by law and the statute of limitations.

Children’s Privacy

We do not knowingly collect, maintain, or use any personal information from children under the age of 16, and no part of our Services is directed towards children. If you are under the age of 16, please do not submit any personal information through our Websites or Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personal information through the Websites or Services without their permission. Changes to This Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted.
